Bitcoin Gifts in India: Can the Taxman Trace Who Sent the Crypto?

Bitcoin transfers can occur between two individuals without any third party getting involved. It can be transferred from one wallet to another without a bank, paperwork, or even the name appearing on the blockchain. This is also possible when the crypto is paid as a gift. Thus, it is difficult to identify what the transfer was actually for or who was behind the move.

The real question is whether this transaction will be taxed. If a father sends a Bitcoin to his child as a gift, can the taxman trace the transaction and tax it? The answer depends on what the blockchain records and whether the people involved can prove the source and nature of the token.

How are Bitcoin Gifts Taxed in India?

Under Section 56(2)(x) of the Income Tax Act, VDAs are included as “prescribed movable property.” The section suggests that if a person receives such property without consideration and the aggregate fair market value exceeds ₹50,000 during the year, it can be taxable as income. At the same time, gifts received from specified relatives are excluded.

The definition of relative includes a spouse, brother, or sister, lineal ascendants or descendants, and relatives of the spouse and parents. Specifically for Bitcoin gifts, the 2026 Schedule VDA states that a gifted crypto asset’s cost of acquisition is the amount on which tax was paid under Section 56(2)(x), if applicable. In other cases, the cost is the price at which the previous owner purchased it.

For example, if a father bought 0.1 $BTC for ₹15 lakh and gifted it to his child when it was worth ₹45 lakh, the child would not generally need to pay tax on receiving the gift as crypto gifts are exempted under Section 56(2)(x). But if the child later sells the $BTC, the original ₹15 lakh acquisition price would be considered for the tax payment.

Can the Taxman Trace a Bitcoin Gift?

The blockchain can reveal that $BTC was moved from one wallet to another. But it doesn’t say who owns those wallets or why the movement happened. This makes it impossible for the blockchain to find out if it is a Bitcoin gift when the father sends it to the child.

However, when the Bitcoin is later moved to a crypto exchange for further transactions or sales, the details will be recorded as the platform needs KYC and transaction records. If the transaction is questioned, the user may need to explain where the Bitcoin came from.

What Happens If the Taxman Questions a Bitcoin Gift?

Interestingly, if the Bitcoin gift transaction is questioned later by the taxman, the recipient needs to explain its real origin. He needs to prove that it was sent by his father as a gift. Although the blockchain can show wallet addresses, the amount and date of transfer, the sender, recipient, and the reason behind the move will remain hidden.

This is where supporting documents are really important. The recipient should be able to provide the donor’s original purchase records, wallet transaction history, transaction hash, relationship with the donor, and details of the gift.

This means that the blockchain does not automatically tell the taxman that the Bitcoin was a gift. So when the transfer becomes questionable later during AML or tax scrutiny, the recipient should be able to prove that.
